Q: WHAT ARE MY VOTING RIGHTS IN THE CONDOMINIUM ASSOCIATION?
A: The Members of the Association are entitled to cast one vote for each Condominium Unit owned by them.
Q: WHAT RESTRICTIONS EXIST IN THE CONDOMINIUM DOCUMENTS ON MY RIGHT TO USE MY UNIT?
A: There are various restrictions relating to residential use, nuisance, lawful use, leaking, commercial usage, rules and regulations, and conveyances. These restrictions are contained in Article XI of the Declaration of Condominium.
Q: WHAT RESTRICTIONS EXIST IN THE CONDOMINIUM DOCUMENTS ON THE LEASING OF MY UNIT?
A: Leases must obtain the prior written approval of the Association, which is not allowed to un-reasonably withhold approvals. The Association may require reasonable documentation in order to insure rights of other owners (See Article XI, D). Also, please, refer to the Rules and Regulations.
Q: HOW MUCH ARE MY MONTHLY ASSESSMENTS TO THE CONDOMINIUM ASSOCIATION FOR MY UNIT TYPE AND WHEN ARE THEY DUE?
A: Assessments are due on the lst of each month and as of the 2007 Budget Year are as follows:
$301.00 - Commercial Unit
$317.00 - Studio
$493.00 - 1 Bedroom/1.5bath (Line 15, no balcony)
$496.00 - 1 Bedroom/1.5bath
$726.00 - 2 Bedroom/2.5bath (inside)
$736.00 - 2 Bedroom/2.5bath (corner)
$91600 - 3 Bedroom/3bath
Q: ARE THERE ANY SPECIAL ASSESSMENTS CURRENTLY? IF SO, GIVE DETAILS
A: No new Special Assessments are currently planned. This past year, our Concrete Fencing, Pavement Resealing, and Hallway Refurbishment & other Common Element Renovations projects has already been completed and monies for these project was already collected and paid for in the last (2007) Special Assessment.
Q: DO I HAVE TO BE A MEMBER IN ANY OTHER ASSOCIATION? IF SO, WHAT IS THE NAME OF THE ASSOCIATION AND WHAT ARE MY VOTING RIGHTS IN THIS ASSOCIATION? ALSO, HOW MUCH ARE MY ASSESSMENTS?
A: No, there is no other Association.
Q: AM I REQUIRED TO PAY RENT OR LAND USE FEES FOR RECREATIONAL OR OTHER COMMONLY USED FACILITIES? IF SO, HOW MUCH AM I OBLIGATED TO PAY ANNUALLY.
A: There is no recreational or other lease associated with Biscayne 21 with the exception for rental of the penthouse for private parties. See Rules and Regulations: Recreation Room for rental details.
Q: IS THE CONDOMINIUM ASSOCIATION OR OTHER MANDATORY MEMBERSHIP ASSOCIATION INVOLVED IN ANY COURT CASES IN WHICH IT MAY FACE LIABILITY IN EXCESS OF $100,000? IF SO, IDENTIFY EACH SUCH CASE.
Q: ARE PETS ALLOWED ON TO BISCAYNE 21 PROPERTY?
A: Pets are allowed only for owners who reside on the property and under strict provisions. Renters (non-owners) are not permitted to keep pets at the Biscayne 21 Condominium and visitors are not permitted to bring pets on to the property at any time. Resident Owners keeping pets must pick up after them while on the property and that such pets are to be taken to the designated Dog Run Area for their normal duties.
